Washington, D.C. -- House Democratic Leader Nancy Pelosi released the following statement today on the Bureau of Labor Statistics' announcement that 470,000 people abandoned their job searches in July and that 3.2 million private sector jobs have been lost since President Bush took office:

“The fact is that President Bush’s misguided economic policies have failed to create jobs. Since President Bush took office, the country has lost 3.2 million jobs, the worst record since President Hoover. And today we learned that in July nearly half a million people gave up looking for a job.

“Job losses are taking a real toll on the financial security of American families. While Democrats are fighting for opportunity, jobs, and economic security for working families, Republicans continue to focus on helping those who need help the least.

ObamaJobs: Uncle Sam's Hiring Hall

The U.S. can't have new entrepreneurs and tax them too.

Every serious person should welcome the president's proposals to lift the dormant economy and reduce unemployment. Not because every serious person would agree with them but because they are a clear test of how a left-wing government would run the American economy.

If this works, hats off to them and we become France. If not, Americans may finally dump left-wing economics into the ash heap of history, starting next November and then in the next presidential election, which can't come soon enough.

The first purpose of the jobs proposals Mr. Obama announced Tuesday—TARP money for Main Street, tax credits for new hires, more infrastructure spending and the weird weatherization program—is to bail out Democratic incumbents. The underlying strength and resilience of the American economy may yet produce enough headline growth the next 11 months to slow the panic over employment levels by next fall.

No Democratic president, though, can just say, "I'm doing this to save the Pelosi majority and to protect the state and local jobs of Andy Stern's dues payers and party regulars in the Service Employees International Union." Mr. Obama's saving grace is that no matter how political his initiatives, the reasons he offers for what he's doing generally do describe what is at stake.

And so he did at the jobs summit: "We've got the most entrepreneurial spirit in the world, and we've got some of the most productive workers in the world. And if we get serious, then the 21st century is going to be the American century, just like the 20th century."

Too true. This global competition is what lies beyond the politics of next November's employment rate. Still, one must ask: Can weatherization save us from a billion Chinese workers?

Apologies for the glibness, but I don't see how one can sort through the Obama economic policies and conclude that we have a strategy for sending America's best and brightest entrepreneurs onto the battlefields of Asia. It looks instead like we're going to spend a generation looking for jobs in Uncle Sam's hiring hall of targeted tax credits and industry-specific subsidies.

Everyone in politics genuflects in the direction of the job-creation powers of "entrepreneurs" and their ideas. But the generation of Democrats who rose to power with the Obama presidency and the current House majority don't really trust or much like real entrepreneurs.

Entrepreneurship, the kind that creates industries and jobs on the scale we'll need in the next century, is about two things: Ideas that spring randomly from some slightly crazed dreamer's head; and worse, they often get filthy rich if the dreams are real. The left likes neither.

In their country, government guides capital to ideas prewashed for goodness. As to letting guys get rich, we know about that problem. Hating it isn't just political. It's cultural.

But unless these Democrats can reverse habits of history dating to the Renaissance, entrepreneurship's new men not only will build businesses and create new jobs, they'll still tend to measure their self-worth with outsized yachts, mansions and other crimes against prevailing norms of taste. The new Democrats bear a visceral antipathy toward these people, whom they've reduced to the lumpen "Republicans."

Barack Obama campaigned for a year against "the top 1%" and "the wealthiest." It sounded like more than economics to me. But a nation can't have entrepreneurs and eat them, too. Asia is overflowing with rich entrepreneurs. Google "China's auto industry." They have more new auto manufacturers than you can count. If the U.S. has any hope of competing long term with this rising force, it will have to let some Americans get as rich as nouveau riche Asians. This presidency won't do that.

At the jobs summit, Mr. Obama said "I want to hear from CEOs what's holding back our business investment." Really?

How about the world's highest corporate tax rate? How about the 5.4% health-care surtax on top of the expiring Bush tax cuts, which will push the top marginal individual rate, paid at the outset by many entrepreneurs, well over 40%?

Set aside income taxes as the unransomed hostages of progressive dogma. Justify this: The Senate health-reform bill imposes a $4 billion annual excise tax on medical devices and diagnostic equipment. In a slow-innovation economy, which is what we have now, medical and diagnostic miracles sit at the intersection of American science, technology, education and IQ. That stuff defines American entrepreneurship and ingenuity. If the Obama Democrats will tax these people, they'll tax anything that produces income, no matter how innovative or job-creating.

The Obama bet is that the U.S. can be a Franco-German welfare state, with a mammoth public sector, and still compete with China, India, Brazil, Korea and the rest. This is a pipedream. We are going to spend four years treading water. If we tread quickly enough, we may get enough growth to save the Democrats, but not the nation.

A Doctor's Plan for Legal Industry Reform

My modest proposal to rearrange how lawyers do business.

Since we are moving toward socialism with ObamaCare, the time has come to do the same with other professions—especially lawyers. Physician committees can decide whether lawyers are necessary in any given situation.

At a town-hall meeting in Portsmouth, N.H., last month, our uninformed lawyer in chief suggested that we physicians would rather chop off a foot than manage diabetes since we would make more money doing surgery. Then President Obama compounded his attack by claiming a doctor's reimbursement is between "$30,000" and "$50,000" for such amputations! (Actually, such surgery costs only about $1,500.)

Physicians have never been so insulted. Because of these affronts, I will gladly volunteer for the important duty of controlling and regulating lawyers. Since most of what lawyers do is repetitive boilerplate or pushing paper, physicians would have no problem dictating what is appropriate for attorneys. We physicians know much more about legal practice than lawyers do about medicine.

Following are highlights of a proposed bill authorizing the dismantling of the current framework of law practice and instituting socialized legal care:

• Contingency fees will be discouraged, and eventually outlawed, over a five-year period. This will put legal rewards back into the pockets of the deserving—the public and the aggrieved parties. Slick lawyers taking their "cut" smacks of a bookie operation. Attorneys will be permitted to keep up to 3% in contingency cases, the remainder going into a pool for poor people.

• Legal "DRGs." Each potential legal situation will be assigned a relative value, and charges limited to this amount. Program participation and acceptance of this amount is mandatory, regardless of the number of hours spent on the matter. Government schedules of flat fees for each service, analogous to medicine's Diagnosis Related Groups (DRGs), will be issued. For example, any divorce will have a set fee of, say, $1,000, regardless of its simplicity or complexity. This will eliminate shady hourly billing. Niggling fees such as $2 per page photocopied or faxed would disappear. Who else nickels-and-dimes you while at the same time charging hundreds of dollars per hour? I'm surprised lawyers don't tack shipping and handling onto their bills.

• Legal "death panels." Over 75? You will not be entitled to legal care for any matter. Why waste money on those who are only going to die soon? We can decrease utilization, save money and unclog the courts simultaneously. Grandma, you're on your own.

• Ration legal care. One may need to wait months to consult an attorney. Despite a perceived legal need, physician review panels or government bureaucrats may deem advice unnecessary. Possibly one may not get representation before court dates or deadlines. But that' s tough: What do you want for "free"?

• Physician controlled legal review. This is potentially the most exciting reform, with doctors leading committees for determining the necessity of all legal procedures and the fairness of attorney fees. What a wonderful way for doctors to get even with the sharks attempting to eviscerate the practice of medicine.

• Discourage/eliminate specialization. Legal specialists with extra training and experience charge more money, contributing to increased costs of legal care, making it unaffordable for many. This reform will guarantee a selection of mediocre, unmotivated attorneys but should help slow rising legal costs. Big shot under indictment? Classified National Archives documents down your pants? Sitting president defending against impeachment? Have FBI agents found $90,000 in your freezer? Too bad. Under reform you too may have to go to the government legal shop for advice.

• Electronic legal records. We should enter the digital age and computerize and centralize legal records nationwide. All files must be in a standard, preferably inconvenient, format and must be available to government agencies. A single database of judgments, court records, client files, etc. will decrease legal expenses. Anyone with Internet access will be able to search the database, eliminating unjustifiable fees charged by law firms for supposedly proprietary information, while fostering transparency. It will enable consumers to dump their clunker attorneys and transfer records easily.

• Ban legal advertisements. Catchy phone numbers such as 1-800-LAWYERS would be seized by the government and repurposed for reporting unscrupulous attorneys.

• New government oversight. Government overhead to manage the legal system will include a cabinet secretary, commissioners, ombudsmen, auditors, assistants, czars and departments.

• Collect data about the supply of and demand for attorneys.Create a commission to study the diversity and geographic distribution of attorneys, with power to stipulate and enforce corrective actions to right imbalances. The more bureaucracy the better. One can never have too many eyes watching these sleazy sneaks.

• Lawyer Reduction Act (H.R. -3200). A self-explanatory bill that not only decreases the number of law students, but also arbitrarily removes 3,200 attorneys from practice each year. Textbook addition by subtraction.

Enthusiastically embracing the above legal changes can serve as a "teachable moment" and will go a long way toward giving the lawyers who run Congress a taste of their own medicine.

Global Warmists Just Can't Lose
For years we've been hearing that computer models prove beyond doubt that the Earth is imperiled by "global warming." But as USA Today reports, a new study calls this into doubt:

The report found that only about half of the warming that occurred during a natural climate change 55 million years ago can be explained by excess carbon dioxide in the atmosphere. What caused the remainder of the warming is a mystery.

"In a nutshell, theoretical models cannot explain what we observe in the geological record," says oceanographer Gerald Dickens, study co-author and professor of Earth Science at Rice University in Houston. "There appears to be something fundamentally wrong with the way temperature and carbon are linked in climate models."

Some 55 million years ago, during a period called the Palaeocene-Eocene thermal maximum, the average temperature increased by 13 degrees over 10,000 years. At the same time, "the amount of carbon in Earth's atmosphere rose rapidly," presumably because there were no hybrid cars or fluorescent light bulbs--but not rapidly enough, given the models, to account for more than a small proportion of the warming. Conclusion: "Some feedback loop or other processes that aren't accounted for in these models"--not carbon--were responsible for much of the warming.

The Union of Concerned Scientists, a left-wing advocacy group, put out a press release claiming that the study shows "the potential consequences of global warming are likely worse than what scientists are predicting"--as if carbon is the only thing that can cause warming.

So first the global warmists insist that the question is settled beyond debate, then, when it turns out not to be, they insist that uncertainly can only mean their theory is even more true than they had thought. This just is not how real science operates.

Dissecting the Kennedy Health Bill
No, you won't be able to keep your insurance if you like it.

Last September Sen. Barack Obama promised that under his health-care proposal "you'll be able to get the same kind of coverage that members of Congress give themselves." On Monday, President Obama repeated that promise in a speech to the American Medical Association. It's not true.
The president is barnstorming the nation, urging swift approval of legislation that is taking shape in Congress. This legislation -- the Affordable Health Choices Act that's being drafted by Sen. Edward Kennedy's staff and the Health, Education, Labor and Pensions Committee -- will push Americans into stingy insurance plans with tight, HMO-style controls. It specifically exempts members of Congress (along with federal employees; the exemptions are in section 3116).
Members of Congress "enjoy the widest selection of health plans in the country," according to the U.S. Office of Personnel Management. They "can choose from among consumer-driven and high deductible plans that offer catastrophic risk protection with higher deductibles, health saving/reimbursable accounts and lower premiums, or fee-for-service (FFS) plans, and their preferred provider organizations (PPO), or health maintenance organizations (HMO)." These choices would be nice for all of us, but they're not in the offing. Instead, if you don't enroll in a "qualified" health plan and submit proof of enrollment to the federal government, you'll be tracked down and fined (sections 3101 and 6055).
For a health plan to count as "qualified," it has to meet all the restrictions listed in the legislation and whatever criteria the Secretary of Health and Human Services imposes after the bill becomes law. You may think you're in a "qualified" plan, but the language suggests that only plans with managed-care controls such as the "medical home" will meet the definition (sections 3101 and 2707).
"Medical home" is this decade's version of HMO-style insurance, according to the Congressional Budget Office, with a primary-care provider to manage your access to costly services such as visits to specialists and diagnostic tests. Medical home providers in "qualified" plans, states the Kennedy bill, will have a "payment structure" based on "incentives" rather than payments for each doctor visit or procedure (section 3101).
These requirements are reminiscent of the unpopular controls HMOs imposed two decades ago that caused public outrage and led to state laws reining in abuses. In December 2008, a Congressional Budget Office report evaluating early drafts of major federal health insurance proposals noted that "medical homes" were likely to resemble the HMO gatekeepers of 20 years ago if cost control is a priority.
That report specifically referred to a payment incentive called the "withhold." When HMOs became dominant in the early 1990s, they would withhold 10% or more of physicians' fees until the end of the year and give it back only to the physicians who met targets for limiting how many referrals to specialists or diagnostic tests their patients used.
The targets were so stringent that, if they were exceeded, what a doctor prescribed for you came out of your doctor's own pocket at the end of the year. This set up a conflict of interest between you and your doctor.
Mr. Obama tried to put a positive spin on such cost controls in his June 13 weekly radio address. He said "if doctors have incentives to provide the best care, instead of more care, we can help Americans avoid unnecessary hospital stays, treatments and tests that drive up costs." Fair enough -- if you want your doctor paid to police your care and to be financially penalized for that extra test or referral you get.
It is reasonable to require that people who accept a government subsidy for health insurance tolerate cost controls to protect taxpayers. But according to the terms of the Kennedy bill, you must enroll in a "qualified" plan or face a fine, even if you and your employer are paying the entire cost of the plan you already have (section 161).
The president has promised that if you like your plan you can keep it. Mr. Kennedy's bill says that too. It's doubletalk, as the consequences of nonenrollment make clear. How big a fine will you face? The bill doesn't specify or set a limit. It says the fine will be enough to "accomplish the goal of enhancing participation in qualifying coverage" (section 161).
If legislation similar to the Kennedy bill lands on Mr. Obama's desk, he has an obligation to keep his promises to the American people and veto it. And whatever health-insurance law is passed should apply to members of Congress. If it isn't good enough for them, it shouldn't be imposed on the rest of us.

The Death and Life of Health 'Reform'

A glimpse of a future without nationalized health care.

The following is a draft of a speech titled "The Obama Years: A Reappraisal" that mysteriously was never delivered at the 2070 national meeting of the Institute of Advanced Obamalogy:

So it came to pass in the waning days of the health-care wars that Democrats learned the American people really didn't want a nationalized health-care industry.

The Obama administration's "public option," which all knew to be a vote for a government takeover, proved a drink too stiff for four or five Democratic senators whose re-election was not in the bag.

President Obama applauded himself for achieving "85% of what we set out to accomplish." But pundits and wonks were in despair. They retreated to their watering holes and cried into their Stoli martinis. The cause of their lives was over. A once-in-a-generation opportunity had been muffed. Without a massive bill in Congress, with many titles and subtitles and subchapters, they moaned, there was no hope for fixing all that ailed the American health-care system.

But politics went on, and while the armies of wonkdom mourned, three little-known congressmen (Eric Paul, Ryan Cantor and Kemp Newtley) discovered an unexpected public enthusiasm for a flat tax.

Through incessant Twittering over the heads of the media, they persuaded millions of voters they'd be better off with lower rates even if it meant giving up tax-free employer provided health insurance. It didn't hurt, either, that the wailing of insurance and medical lobbyists was over-the-top -- convincing voters that the tax benefit really was just a form of corporate welfare disguised as a mostly illusory benefit for individuals.

Though the realization was slow in dawning, policy experts would eventually rediscover what they had known all along (but had conveniently forgotten in order to lend their voices to "solutions" that required ever more government spending) -- that tax reform, in the American context, is health-care reform.

And, lo, it proved true, as 100 million intelligent, well-educated employees of Corporate America were allowed to see for the first time what "tax free" health insurance was really costing them. They saw how it distorted their behavior and caused them to allocate far more of their incomes to the medical-industrial complex than they would have chosen for themselves.

Eyes newly opened, they demanded cheaper insurance options, covering fewer services (cancer wigs, family counseling, in-vitro fertilization), and opted for plans with higher deductibles and co-pays in return for much lower monthly rates.

Because consumers were now spending their "own" money on health care, doctors and hospitals found it necessary to publish and even advertise their prices. A hospital that specialized in heart surgery, performing thousands of procedures a year, found it had both the highest quality and lowest cost -- and now marketed itself as such. Ditto specialists in cancer, diabetes and other conditions.

For the first time, Americans spent less and got more. Spending fell overnight by 13%, which happened to be exactly what economists had predicted if the price tags were restored to health care and consumers were allowed to see clearly what they were getting (or not getting) for their money. As predicted, too, spending thereafter rose only in line with incomes.

What's more, many fewer people remained voluntarily uninsured now that health insurance was no longer a gold-plated extravagance affordable only by those in the top brackets who could slough off 40% of the cost on other taxpayers. Existing programs for the needy, in turn, could be downsized and revamped into voucher programs. The federal budget benefited twice over -- from fewer claimants and from medical care that was less costly. Fiscal wreck was avoided.

In truth, President Obama had been little involved to this point. Following his early domestic "successes," he was spending more and more time abroad sharing his matchless eloquence with previously unblessed audiences from Ulan Bator to Ouagadougou.

A highly symbolic moment, however, came when Mr. Obama, who had put on weight in office and now tipped the scales at nearly 300 pounds, returned from a speaking tour on the virtues of nonproliferation to audiences in the Islamic Republic of Palau. Having overindulged in local delicacies, he was surprised when the White House medical office handed him a Wal-Mart debit card and sent him to a nearby Wal-Mart supercenter boasting "Everyday Low Prices on Gastric Bypass Surgery."

Emerging afterward to the usual crowd of ululating network reporters and bloggers, Mr. Obama pronounced himself entirely pleased and satisfied with the "success of my health-care reforms."

And so it came to pass that historians and Obamalogists would count health-care reform among the incomparable triumphs of the Obama administration, and lost to history would be the names of Eric Paul, Ryan Cantor and Kemp Newtley.

The Associated Press reports on what it gently calls a "quirk" in the so-called stimulus law:

When President Barack Obama increased unemployment benefits as part of his economic stimulus, he also made some Americans ineligible for hundreds of dollars a month in food stamps.

Under the economic recovery plan, laid-off workers have seen a $25 weekly bump in their unemployment checks as part of a broad expansion of benefits for the poor. But the law did not raise the income cap for food stamp eligibility, so the extra money has pushed some people over the limit.

Laid-off workers and state officials are only now realizing the quirk, a consequence of pushing a $787 billion, 400-page bill through Congress and into law in three weeks.

And for people hurt by the change, there's no way around it.

This is why it's so important to give these genuises control over our health care right this second!

Last month the Government Accountability Office issued a shocking report on "selected cases of death and abuse"--not at Guantanamo Bay or other detention facilities for terrorists, but at schools for American children:

GAO also examined the details of 10 restraint and seclusion cases in which there was a criminal conviction, a finding of civil or administrative liability, or a large financial settlement. The cases share the following common themes: they involved children with disabilities who were restrained and secluded, often in cases where they were not physically aggressive and their parents did not give consent; restraints that block air to the lungs can be deadly; teachers and staff in the cases were often not trained on the use of seclusions and restraints; and teachers and staff from at least 5 of the 10 cases continue to be employed as educators.

The 10 cases involved children ranging in age from 4 to 14, and eight of the cases occurred at government schools. Here is just a sample:

At a public school in West Virginia, a 4-year-old girl with cerebral palsy and autism "was 'uncooperative,' so teachers restrained her in a chair with multiple leather straps that resembled a 'miniature electric chair.' " The girl was later diagnosed with posttraumatic stress disorder. "At least one of the three teachers responsible" is still at the school.

At a Texas public school, a 230-pound "special education teacher" placed a 129-pound boy of 14 "into a prone restraint and lay on top of him because he would not stay seated." The student died. The case was ruled a homicide but no charges were filed. The teacher "currently teaches in Virginia and is licensed to instruct children with disabilities."

In a California public school, the teacher of a 7-year-old autistic girl "secluded child in a walled off area because she refused to do work, sat on top of her because she was wiggling a loose tooth, and repeatedly restrained and abused her." The teacher "left the school but began teaching again in a different school district."

"GAO could not determine whether allegations were widespread," the report disclaims, but it makes clear they are more widespread than just the 10 cited cases:

GAO did find hundreds of cases of alleged abuse and death related to the use of these methods on school children during the past two decades. Examples of these cases include a 7 year old purportedly dying after being held face down for hours by school staff, 5 year olds allegedly being tied to chairs with bungee cords and duct tape by their teacher and suffering broken arms and bloody noses, and a 13 year old reportedly hanging himself in a seclusion room after prolonged confinement.

When the report came out on May 19, we figured it would be a good opportunity to find common ground with politicians and commentators who've been complaining for years about the "torture" of terrorists. We figured President Obama would issue an executive order banning torture in schools, the New York Times would publish an indignant editorial, Dick Durbin would take to the Senate floor to declare that the teachers unions remind him of the Gestapo, and that nut who writes for The Atlantic would proclaim himself "shocked to the core."

We were going to respond by saying that although we think there are circumstances under which it is justifiable to treat terrorists roughly, all good people can agree that torturing schoolchildren is categorically wrong. But we didn't have anything to respond to. As far as we are aware, the GAO's findings have been greeted with silence by the leading self-proclaimed "torture" opponents--though Education Secretary Arne Duncan did tepidly promise "he will ask state school chiefs around the country about the use of restraints and confinement of pupils in the classroom," according to the Associated Press.

Where's the outrage? Could it be that all the complaining about "torture" was but a pretext for some less noble agenda?

Some businesses see nothing but profits in the green movement.

Some business leaders are cozying up with politicians and scientists to demand swift, drastic action on global warming. This is a new twist on a very old practice: companies using public policy to line their own pockets.
The tight relationship between the groups echoes the relationship among weapons makers, researchers and the U.S. military during the Cold War. President Dwight Eisenhower famously warned about the might of the "military-industrial complex," cautioning that "the potential for the disastrous rise of misplaced power exists and will persist." He worried that "there is a recurring temptation to feel that some spectacular and costly action could become the miraculous solution to all current difficulties."
This is certainly true of climate change. We are told that very expensive carbon regulations are the only way to respond to global warming, despite ample evidence that this approach does not pass a basic cost-benefit test. We must ask whether a "climate-industrial complex" is emerging, pressing taxpayers to fork over money to please those who stand to gain.
This phenomenon will be on display at the World Business Summit on Climate Change in Copenhagen this weekend. The organizers -- the Copenhagen Climate Council -- hope to push political leaders into more drastic promises when they negotiate the Kyoto Protocol's replacement in December.
The opening keynote address is to be delivered by Al Gore, who actually represents all three groups: He is a politician, a campaigner and the chair of a green private-equity firm invested in products that a climate-scared world would buy.
Naturally, many CEOs are genuinely concerned about global warming. But many of the most vocal stand to profit from carbon regulations. The term used by economists for their behavior is "rent-seeking."
The world's largest wind-turbine manufacturer, Copenhagen Climate Council member Vestas, urges governments to invest heavily in the wind market. It sponsors CNN's "Climate in Peril" segment, increasing support for policies that would increase Vestas's earnings. A fellow council member, Mr. Gore's green investment firm Generation Investment Management, warns of a significant risk to the U.S. economy unless a price is quickly placed on carbon.
Even companies that are not heavily engaged in green business stand to gain. European energy companies made tens of billions of euros in the first years of the European Trading System when they received free carbon emission allocations.
American electricity utility Duke Energy, a member of the Copenhagen Climate Council, has long promoted a U.S. cap-and-trade scheme. Yet the company bitterly opposed the Warner-Lieberman bill in the U.S. Senate that would have created such a scheme because it did not include European-style handouts to coal companies. The Waxman-Markey bill in the House of Representatives promises to bring back the free lunch.
U.S. companies and interest groups involved with climate change hired 2,430 lobbyists just last year, up 300% from five years ago. Fifty of the biggest U.S. electric utilities -- including Duke -- spent $51 million on lobbyists in just six months.
The massive transfer of wealth that many businesses seek is not necessarily good for the rest of the economy. Spain has been proclaimed a global example in providing financial aid to renewable energy companies to create green jobs. But research shows that each new job cost Spain 571,138 euros, with subsidies of more than one million euros required to create each new job in the uncompetitive wind industry. Moreover, the programs resulted in the destruction of nearly 110,000 jobs elsewhere in the economy, or 2.2 jobs for every job created.
The cozy corporate-climate relationship was pioneered by Enron, which bought up renewable energy companies and credit-trading outfits while boasting of its relationship with green interest groups. When the Kyoto Protocol was signed, an internal memo was sent within Enron that stated, "If implemented, [the Kyoto Protocol] will do more to promote Enron's business than almost any other regulatory business."
The World Business Summit will hear from "science and public policy leaders" seemingly selected for their scary views of global warming. They include James Lovelock, who believes that much of Europe will be Saharan and London will be underwater within 30 years; Sir Crispin Tickell, who believes that the United Kingdom's population needs to be cut by two-thirds so the country can cope with global warming; and Timothy Flannery, who warns of sea level rises as high as "an eight-story building."
Free speech is important. But these visions of catastrophe are a long way outside of mainstream scientific opinion, and they go much further than the careful findings of the United Nations panel of climate change scientists. When it comes to sea-level rise, for example, the United Nations expects a rise of between seven and 23 inches by 2100 -- considerably less than a one-story building.
There would be an outcry -- and rightfully so -- if big oil organized a climate change conference and invited only climate-change deniers.
The partnership among self-interested businesses, grandstanding politicians and alarmist campaigners truly is an unholy alliance. The climate-industrial complex does not promote discussion on how to overcome this challenge in a way that will be best for everybody. We should not be surprised or impressed that those who stand to make a profit are among the loudest calling for politicians to act. Spending a fortune on global carbon regulations will benefit a few, but dearly cost everybody else.

All of these things are happening at a time when natural gas is abundant and cheap. The new technology of horizontal fraccing has made it economically feasible to drill into vast shale deposits in many states, even famously difficult ones like Michigan and New York. Many cars could run on natural gas, much like many buses do already. On a recent trip to Peru, I learned that most taxicabs have been converted to natural gas for a cost of about $1,000 each. New technologies continually revive old oil and gas fields and make new ones economically viable. So it's little more than socialist Malthusianism to argue that the world is running out of cheap energy. Science will always find and harness new sources.

Seeking to Save the Planet, With a Thesaurus

WASHINGTON — The problem with global warming, some environmentalists believe, is “global warming.”

The term turns people off, fostering images of shaggy-haired liberals, economic sacrifice and complex scientific disputes, according to extensive polling and focus group sessions conducted by ecoAmerica, a nonprofit environmental marketing and messaging firm in Washington.

Instead of grim warnings about global warming, the firm advises, talk about “our deteriorating atmosphere.” Drop discussions of carbon dioxide and bring up “moving away from the dirty fuels of the past.” Don’t confuse people with cap and trade; use terms like “cap and cash back” or “pollution reduction refund.”

EcoAmerica has been conducting research for the last several years to find new ways to frame environmental issues and so build public support for climate change legislation and other initiatives. A summary of the group’s latest findings and recommendations was accidentally sent by e-mail to a number of news organizations by someone who sat in this week on a briefing intended for government officials and environmental leaders.

Asked about the summary, ecoAmerica’s president and founder, Robert M. Perkowitz, requested that it not be reported until the formal release of the firm’s full paper later this month, but acknowledged that its wide distribution now made compliance with his request unlikely.

The research directly parallels marketing studies conducted by oil companies, utilities and coal mining concerns that are trying to “green” their images with consumers and sway public policy.

Environmental issues consistently rate near the bottom of public worry, according to many public opinion polls. A Pew Research Center poll released in January found global warming last among 20 voter concerns; it trailed issues like addressing moral decline and decreasing the influence of lobbyists. “We know why it’s lowest,” said Mr. Perkowitz, a marketer of outdoor clothing and home furnishings before he started ecoAmerica, whose activities are financed by corporations, foundations and individuals. “When someone thinks of global warming, they think of a politicized, polarized argument. When you say ‘global warming,’ a certain group of Americans think that’s a code word for progressive liberals, gay marriage and other such issues.”

The answer, Mr. Perkowitz said in his presentation at the briefing, is to reframe the issue using different language. “Energy efficiency” makes people think of shivering in the dark. Instead, it is more effective to speak of “saving money for a more prosperous future.” In fact, the group’s surveys and focus groups found, it is time to drop the term “the environment” and talk about “the air we breathe, the water our children drink.”

“Another key finding: remember to speak in TALKING POINTS aspirational language about shared American ideals, like freedom, prosperity, independence and self-sufficiency while avoiding jargon and details about policy, science, economics or technology,” said the e-mail account of the group’s study.

Mr. Perkowitz and allies in the environmental movement have been briefing officials in Congress and the administration in the hope of using the findings to change the terms of the debate now under way in Washington.

Opponents of legislation to combat global warming are engaged in a similar effort. Trying to head off a cap-and-trade system, in which government would cap the amount of heat-trapping emissions allowed and let industry trade permits to emit those gases, they are coaching Republicans to refer to any such system as a giant tax that would kill jobs. Coal companies are taking out full-page advertisements promising “clean, green coal.” The natural gas industry refers to its product as “clean fuel green fuel.” Oil companies advertise their investments in alternative energy.

Robert J. Brulle of Drexel University, an expert on environmental communications, said ecoAmerica’s campaign was a mirror image of what industry and political conservatives were doing. “The form is the same; the message is just flipped,” he said. “You want to sell toothpaste, we’ll sell it. You want to sell global warming, we’ll sell that. It’s the use of advertising techniques to manipulate public opinion.”

He said the approach was cynical and, worse, ineffective. “The right uses it, the left uses it, but it doesn’t engage people in a face-to-face manner,” he said, “and that’s the only way to achieve real, lasting social change.”

Frank Luntz, a Republican communications consultant, prepared a strikingly similar memorandum in 2002, telling his clients that they were losing the environmental debate and advising them to adjust their language. He suggested referring to themselves as “conservationists” rather than “environmentalists,” and emphasizing “common sense” over scientific argument.

And, Mr. Luntz and Mr. Perkowitz agree, “climate change” is an easier sell than “global warming.”

Torture and the 'Truth Commission'

Why has Congress failed to outlaw waterboarding?

By WILLIAM MCGURN

Sen. Patrick Leahy (D., Vt.) wants a commission that will get to the "truth" about torture. House Speaker Nancy Pelosi (D., Calif.) says she wants a truth commission too. And so does Rep. John Conyers (D., Mich.).

On CBS's "Face the Nation" on Sunday, Mr. Leahy said a truth commission would help get to the heart of how the recently released memos on CIA interrogation techniques were drafted. "I want to know why they did that," he said. "What kind of pressures brought them to write things that are so off the wall and to make sure it never happens again. That's why I want [a Truth Commission]."

Mr. Leahy overlooks a small point here: Under our Constitution, the truth commission is supposed to be Congress.

Our Founders didn't look to outsource our most controversial public issues to appointees. They established institutions and arrangements that would hold those who have power accountable to the American people. And when the people's lawmakers believed the people's president was misinterpreting the law, the Founders expected the former to stand up and do something about it.

Over the past few years, the Democrats have moved to ban waterboarding only when it was clear that such a bill would not pass -- or would be vetoed by George W. Bush. In September 2006, Sen. Edward Kennedy introduced an amendment to the Military Commissions Act that would have effectively defined waterboarding as a war crime, and it was defeated largely along partisan lines. In February 2008, when Democrats were in control of Congress, they made a big fuss about sending a bill that would have limited interrogation to techniques found in the Army field manual. They did so knowing President Bush would veto it, and that he had the votes to sustain that veto.

Today the Democrats have an even larger majority -- plus a president who would sign such legislation. So why the call for a truth commission instead? The answer is a nasty one: If Congress made waterboarding illegal now, they would be making clear that it was not illegal before.

Andrew McCarthy is the former assistant U.S. attorney who put Omar Abdel-Rahman (the blind sheik) behind bars for the first bombing of the World Trade Center in 1993. Mr. McCarthy explained it this way to me: "When Senate Democrats didn't have the votes, they voted to make waterboarding illegal. Now they have the votes, but there's no effort to ban waterboarding. And the reason is that they are more interested in setting off a partisan witch hunt than passing a principled ban on something they say is torture."

In other words, what the Beltway has planned is a circus -- where the decks are stacked, people are smeared, and conclusions are foregone. In such an environment, the only way to restore some sense of fairness is with fuller and more honest disclosure. Here are a few places to start.

First, former vice president Dick Cheney has called for the release of classified memos that he says show the CIA's interrogation program produced valuable intelligence that helped us break up terrorist plots and save innocent lives. Though CIA Director Dennis Blair fudged his own answer to Mr. Cheney's claim by issuing two separate statements -- one for public consumption, one for internal use -- he did concede that the program yielded "high value" intelligence. Since then, we've had nothing but claims and counterclaims. How about releasing the info and allowing the American people to judge?

Second, Mrs. Pelosi has categorically declared the CIA never told her waterboarding was being used. "My experience was they did not tell us they were using that, flat out," she recently told reporters. "And any, any contention to the contrary is simply not true."

Her claim puts her at odds with Porter Goss, a former CIA director who had at the time of the briefings served on the same House Intelligence Committee with Mrs. Pelosi. In an op-ed for the Washington Post on Saturday, Mr. Goss said he was "slack-jawed to read that members claim to have not understood that the techniques on which they were briefed were to actually be employed."

Surely the CIA kept notes about those briefings. How about releasing the record -- how many briefings there were, when they occurred, who was at them, what was said, how our political representatives reacted -- and let the people judge who's telling the truth?

Finally, thus far all the focus has been on the techniques approved by the White House. The impression is that Mr. Bush allowed every technique to go forward. How about releasing any memos that speak to techniques that were rejected -- and the reasons? If there's information in any of these classified documents we don't want our enemies to see, they can easily be redacted on a case-by-case basis.

And if after all this, members of Congress still insist that waterboarding is a war crime, maybe they could explain to the American people why they don't just go ahead and outlaw it.
